One of the most important aspects of Cyprus property taxation is determining which tax legislation applies. While many property disposals fall within the scope of the Capital Gains Tax Law, this is not always the case.

Where the facts and circumstances indicate that the activities constitute a trade or business, such as property development or the repeated acquisition and disposal of real estate, the resulting profits may be subject to Income Tax instead of Capital Gains Tax.

Determining the correct tax treatment requires a careful analysis of the transaction, taking into account the relevant legislation, case law and the established badges of trade, including the intention at the time of acquisition, the frequency of similar transactions, the period of ownership, development activities undertaken, the method of financing and the overall commercial substance of the transaction.

Exemptions

Cyprus tax legislation provides valuable exemptions.


Depending on the nature of the transaction, taxpayers may benefit from various exemptions and reliefs under the Capital Gains Tax Law. These include reliefs relating to principal private residences, agricultural land, lifetime personal exemptions, certain transfers between family members, company reorganisations and other qualifying transactions provided by the legislation.

Following the Cyprus Tax Reform, the lifetime exemptions available under the Capital Gains Tax Law have increased significantly, including the general lifetime exemption, the agricultural land exemption and the principal private residence exemption, which has risen from €85,430 to €150,000.

Each transaction should be reviewed individually to determine which exemptions may apply.

Beyond CGT

Property transactions often involve much more than one tax.


A property disposal may involve the interaction of several areas of Cyprus tax legislation, including Capital Gains Tax, Income Tax, VAT, Stamp Duty, Corporation Tax where applicable, Transfer Fees and International Tax.
